2011 Iowa/Nebraska Healthcare Legislation Wrap Up

According to the June 30 Health Law Advisory published by Baird Holm LLP,the following Iowa and Nebraska laws are among 2011 legislation that will have an impact on the healthcare industry:

Nebraska
  • LB 68 provides that certified nurse midwives are permitted to have clinical privileges at hospitals. Hospitals may not now refuse certified nurse midwives clinical privileges based solely on the category of their license. LB 68 does not mean that hospitals are required to grant privileges to each and every certified nurse midwife who makes an application for privileges. If hospitals receive applications for privileges from certified nurse midwives, those applications must be processed and reviewed in the same or a similar fashion as other practitioners who may seek privileges at the hospital.
  • LB 431 provides protection for individuals who participate in peer review activities and protects the confidentiality of peer review records.
Iowa
  • SF 149 allows physician assistants and advanced registered nurse practitioners to disclose a mental or physical condition that renders a person incompetent to operate a motor vehicle to the Iowa Department of Transportation.
