On April 8, 2010, Ingham (Michigan) County Circuit Court Judge William E. Collette issued a Rehabilitation Order placing American Community Mutual Insurance Company, a Midlands Choice payer, into Rehabilitation. The Commissioner of the Office of Financial and Insurance Regulation (OFIR) has been named as the company's Rehabilitator.
Rehabilitation is a corporate reorganization under Chapter 81 of the Michigan Insurance Code that is conducted under the supervision of the Ingham County Circuit Court. This allows OFIR to ascertain American Community's financial condition and implement steps to protect American Community policyholders and creditors.
According to information published by OFIR:
- Patients with coverage through American Community will continue to be covered as long as premiums are paid.
- The Rehabilitation Order prohibits healthcare providers from seeking payment from patients for covered services.
- Patients are still responsible for deductibles, non-covered services and copayments.
American Community claims and appeals that haven't already been filed should be submitted as soon as possible.
